In a 5 to 4 decision, the idiots on the Supreme Court have decided that terrorists are covered by our Constitution, no matter where they are captured and held.
Justice Anthony Kennedy, writing for the majority, said, "The laws and Constitution are designed to survive, and remain in force, in extraordinary times." He was joined by the court's four more liberal justices, Stephen Breyer, Ruth Bader Ginsburg, David Souter and John Paul Stevens.
This is the third time the justices have told President Bush that his plan for handling foreign terrorists violates the Constitution. (NPR)

In a 5 to 4 decision, the idiots on the Supreme Court have decided that terrorists are covered by our Constitution, no matter where they are captured and held.
This is as wrong headed a decision as can be imagined and two of the Justices, Scalia and Roberts, were scathing in their dissent.
But, here is the real result of this ruling. No, it doesn’t “help” the murderers and terrorists get habeas corpus, or find rights, it will kill them on the battlefield. What battlefield commander will waste his time trying to figure out what rights the terrorist he is facing has or doesn’t have?
The proper and reasonable decision to make on the battlefield will be to automatically kill EVERY captured person as soon as you do a quick interrogation. After all, anything else will simply just get the commanders on the line in trouble with the “law.”
And, I cannot say I’d blame any American soldier on the battlefield. Just kill every one of those captured without regard for their status. Their innocence? Immaterial. Kill them anyway.
This is what the dolts on the SCOTUS have wrought.
So, here’s hoping that more of these people are merely executed on the field and left for dead instead of brought into custody, introduced to American rights, and then released into OUR country as they await their undeserved day in court. As they are let go HERE in THIS country while those who would assist them to destroy this country pretends to get them their day in court, they then will have access to THIS country where they can wreck their terrorist agenda.
Nice going SCOTUS. Not only will you be responsible for killing more on the battlefield, but you now have also set up the possibility that terrorists will be let go to freely enter our country to commit acts of terror on us while they pretend to be waiting for their court cases to be adjudicated.
In essence, the SCOTUS is now a party to automatic killing of prisoners and, for those not killed, they are a party to opening up this country for more terrorism. And the SCOTUS has materially damaged our ability to fight terrorists.
The law is an ass.

Yawp...the progressives and friends of Al Qaida are cheering loud, just like the crowds who greeted Neville Chamberlain and he waved a useless piece of paper and stupidly said, "it is peace in our time".
These idiots, by extending a Constitution to non-Americans who mean to destroy the Constitution, are playing Neville's fool game.

I'll hesitate to call them idiots, but I will say it seems they've caved to political correctness and emotion.
I agree strongly with Stop the ACLU in that we'll see more battlefield killings because of this. Atef and Zarqawi didn't get their
habeus corpus rights and nobody cried for 'em.

I'm glad the Supreme Court sides with the Constitution. If siding with the Constitution means siding with Terrorists, then I'll gladly side with Terrorists.

I really don't believe that enemy combattants, especially enemies of foreign origin, should be given any Constitutional rights.
