It’s Relative – It’s Not
By Elizabeth Gonzalez
I thought it was about time I hit the pages for another blog post. I miss blogging, but sometimes I just do not feel I have the words anymore that are in my heart and my head. Lately I have done so much self-introspection that it borders on over-kill.
There are so many issues facing each of us in our lives - personal, business, just stuff that smacks us in our face – we all know the roll call, 1, 2, 3……………..and smack dab you are on your butt. However, we get up and keep on moving on. These days I try not to look back – if such a thing is really ever possible for any of us. Somehow, like September 11, Timothy McVey, the Manson murders, or Patty Hearst – WW11 or Vietnam - some things remain vivid and infamous – indelibly unforgettable. Like pictures in our albums of day, a time, a memory, a wish gone by etched in time.
When studying law you become keenly aware how you have to divorce yourself from your emotions. I will never be so critical again of that doctor with a lousy bedside manner again – maybe he/she really does not mean it. It is more of a coping mechanism to protect ourselves to keep up that professionalism – do not let that guard down. There is a job to be done for the greater good of humanity. I believe that in the case of doctors, but I do question that regarding attorney’s – especially the ambulance chasers. Fortunately, most attorneys have a high moral code – most I said, but not all.
Of late, I have had many conflicts. Discussing our civil and criminal laws is not always as straightforward as it appears. Last week we discussed Harris v. Texas. This is the case where a middle-aged successful dentist in partnership with her husband, also a dentist finds their marriage becoming mediocre. Mrs. Harris hires a private investigator that invariably provides her with the proof she needs to prove he is having an affair with a receptionist that was newly hired at their dental practice. Long story short, she figured out what hotel they were at, and as fate would have it, she saw her husband and his mistress leaving the hotel together. She ran him over repeatedly with her Mercedes. She received a sentence of voluntary manslaughter. She should be up for parole this year sometime.
This week we are learning about so many different issues, in particular identity theft. We are not discussing just the crime, but the fact that someone can steal your identity and you can end up being arrested and criminally charged for the wrongdoing by the perpetrator until law enforcement can actually ascertain you are the victim, not the criminal. The Michelle Brown case from 1999 was a case where her identity was stolen through a rental agency. The secretary had access to her personal information – including credit cards. The rest was history. She ruined Ms. Brown’s credit – at one point Ms. Brown was arrested on a return school trip from Mexico and taken into custody and interrogated for crimes which she was not guilty of. It has taken her years to recover what was stolen from her – not just things, but also her good name.
So becoming a lawyer is giving me so much head knowledge it might implode. It amazes me at the end of the day, however, how relative it is, and is not, all at the same time. The law works for the people, but our politicians seem impervious to the laws. Namely Mr. Obama who has of late made ridiculous statements and outrageous claims in an attempt to win a second term presidency. If the law could work in politics as it does in the judicial system for the average “Joe Some” - I believe Obama would be in jail.
At the end of my day – in closing, I just want to leave you with the thought that no matter what you read or hear – we know not to believe it, though I worry at times about those people that take everything literally without vetting the information out.
Oh yes, I do know this is a rambling post. I am not “with it” and feel out of the loop – having your head in books literally 24/7 has that affect on people, but I would not have it any other way….the rambling or the books. I just remind myself as I progress to “have at it!” It makes sense.

Elizabeth, I was reminded today about the sentiment in your article.
I have regular blogs and websites that I check out regularly with my Google Reader.
Today I checked one site and the top post notified readers that the author was dead.
She had apparently died and a family member posted so her readers would know.
We do not know what the future holds, we must make the most of each day.
It shows us what is really important.

Snake Hunter Sez,
Elizabeth: You know in your heart that the essense of our body of constitutional laws...
handed down to us long ago is good, and that justice will prevail.
